1. Acceptance of Terms
By downloading, installing, or using the WiserBoard app, you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms, please do not use the application.
2. Use of the App
WiserBoard is a project management app designed to work with your existing Kanboard instance or with an instance created using WiserBoard’s service. The app functions as a client, and you acknowledge that WiserBoard does not possess or own your data. You use the app at your own risk, and WiserBoard is not responsible for any loss or damage to your data.
3. Subscription and Payments
Certain features of WiserBoard may require a subscription, and you agree to pay all fees associated with your subscription. Subscription details, including pricing and billing information, can be managed within the app or by contacting the WiserBoard team at their designated email address. Here we outline the terms and conditions for the trial period and renewal options associated with the creation of a WiserBoard instance.
3.1. Trial Period:
a. Duration: The trial period for the WiserBoard instance creation is one month from the date of initiation.
b. Features: During the trial period, users have access to the full range of features and functionalities provided by the WiserBoard instance.
c. Limitations: WiserBoard reserves the right to impose limitations on certain features during the trial period. These limitations will be communicated to users.
3.2. Renewal:
a. Renewal Option: At the end of or during the trial period, users have the option to renew the WiserBoard instance for an extended period. Please note that the account and data will be deleted within 30 days after end of the trial/subscription period if not renewed within time.
b. Subscription Fee: The renewal is subject to a subscription fee, the details of which will be communicated to users prior to the end of the trial period.
c. Payment: Users can renew the instance by making the necessary payment through the WiserBoard app via in-app purchase mechanism. Please make sure to wait for the payment process to finish and in some cases it may take time to update the subscription based on the payment methods used, usually at least 24 hours. In case your subscription is still not updated after this mentioned period, please reach out to us at hello [at] wiserboard.com.
3.3. Cancellation:
a. Cancellation During Trial: Users can cancel the trial at any time without incurring any further charges. Please note that the account and data will be deleted within 30 days after end of the trial period.
b. Cancellation After Renewal: After the renewal, users may cancel their subscription without incurring any further charges. However, please note that WiserBoard has a no-refund policy, and any cancellation after renewal will not result in a refund of the subscription fee. Please note that the account and data will be deleted within 90 days after end of the subscription period.
3.4. Communication:
WiserBoard will communicate with users regarding the trial period, renewal options, and any changes to the subscription fee through email notifications and within the WiserBoard app.
3.5. Changes to Terms:
WiserBoard reserves the right to modify these trial and renewal terms. Users will be notified of any changes, and the updated terms will be effective upon the next renewal.
4. Privacy and Data Security
WiserBoard respects your privacy, and the app is designed to prioritize the security of your data. However, you acknowledge that the app relies on external instances, and WiserBoard is not responsible for the security of data stored on these instances. It is your responsibility to ensure the security and privacy of your data.
5. Intellectual Property
The WiserBoard app and its content are protected by copyright, trademark, and other intellectual property laws. You agree not to reproduce, distribute, or create derivative works based on the app without the express written consent of WiserBoard.
6. Disclaimer of Warranties
WiserBoard is provided “as is” without any warranties, express or implied. WiserBoard makes no representations or warranties of any kind regarding the accuracy, reliability, or availability of the app.
7. Limitation of Liability
To the fullest extent permitted by law, WiserBoard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
8. Modifications to Terms
WiserBoard reserves the right to modify these terms and conditions at any time. Updated terms will be effective upon posting, and it is your responsibility to review them periodically.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Amaravati, MS, India. Any disputes arising out of or in connection with these terms shall be resolved through arbitration in accordance with the rules of the Amaravati Court, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.
